MEMORANDUM OF AGREEMENT

Implementation Terms

The Portland Community College Faculty Federation (the Federation) and Portland Community College (the College) have reached a tentative labor agreement for the term of September 1, 2005 through August 31, 2009 . Upon ratification of the tentative agreement by the Federation members and the PCC Board of Directors, the parties agree to the following implementation terms:

1. Each step or rate in Appendix A through D shall be increased as follows:

Appendix A Full-Time Faculty Salary Schedule

2% effective August 21, 2005 .

2% effective August 21, 2006 .

Appendix B Academic Professional Salary Schedule

2% effective August 21, 2005 .

2% effective August 21, 2006 .

Appendix C Part-Time Faculty Salary Schedule

3% effective August 21, 2005 .

2% effective August 21, 2006 .

Appendix D Full-Time Faculty – Fourth Term Employment and Appendix E – Curriculum Development, Special Projects and Faculty Department Chair Rates

2% effective August 21, 2005 .

2% effective August 21, 2006 .

2. Steps for ABE/GED shall be deleted in year two. Effective Fall term 2006, part-time ABE/GED instructors shall be placed on the lecture step which corresponds to the cumulative number of contact hours completed since 1995. Part-time ABE/GED instructors shall continue to be paid based on an hourly versus a term basis. Workload for Full-time and Part-time Faculty shall continue to be calculated on an hourly basis.

3. A task force of current and former EAC Curriculum Committee members, managers, and others will be formed to assess what existing labs should be reclassified as Lab B.  The assessment will be based on CCOGs in existence at the beginning of Fall term 2005.  The task force will begin its work in Spring 2006. Effective Fall term 2006, Labs which have been determined to meet the definition of Lab B will be assigned a workload factor of .054. Lab B courses taught by part-time faculty shall be paid at the Lab B rate which shall equal the Lecture/Laboratory rate.

4. Year one salary increases for full-time Faculty and full-time and part-time Academic Professionals shall be retroactive to August 21, 2005 and shall be pro-rated for periods of unpaid leave. Retroactive wage increases will be included in the regular payroll checks and will be subject to tax withholding as required by law. The College will make its best efforts to process payment of the retroactive increases on the February 1, 2006 pay day.

5. Year one salary increases for part-time Faculty shall be retroactive to the beginning of fall term 2005. Retroactive wage increases will be included in the regular payroll checks and will subject to tax withholding as required by law. The College will make its best efforts to process payment of the retroactive increases on the February 24, 2006 pay day.

6. Full-time Faculty and full-time and part-time Academic Professionals will receive a one-time lump sum payment of 1% effective August 21, 2005 and effective August 21, 2006 . The lump sum will be based on the annual rate of pay as of August 20 for the applicable year. For part-time employees, the lump sum shall be pro-rated by FTE. For employees hired between August 20, 2005 and December 8, 2005 , the lump sum shall be based on the employee’s annual rate of pay at the time of hire. The College will make its best efforts to process payment of the year one lump sum payment on the March 1, 2006 pay day. The lump sum payments will be included in the regular payroll checks and will be subject to tax withholding as required by law.

7. The College’s maximum monthly contribution to health care premiums shall be as follows for the levels of employee coverage:

Effective January 3, 2006 :

Single party = $480

Two party = $610

Full family = $600

Effective October 1, 2006 :

Single party = $480

Two party = $560

Full family = $690

If cap increases are not in place by January 3, 2006 , employees shall be paid the difference between the $480 cap and the new cap for the period of January 3, 2006 and the date the new cap is implemented. The amount of the new cap shall be determined by the level of health coverage elected by the employee.

8. The College will develop a Flexible Spending Account (FSA) program to allow part-time faculty members to contribute to an FSA effective January 1, 2007 . The FSA will be limited to reimbursement of health care premiums paid by the employee.

9. The College and the Federation agree that parking fees for employees will increase as follows effective the beginning of spring term, 2006:

Carpool (two) (per term) $16.00

Carpool (three +) (per term) Free

Full Time Staff (per year) $100.00

Part Time Staff (per year) $68.00

Adjunct Faculty (per term) $17.00

10. Effective April 4, 2007 , the College and the Federation agree to reopen the Full-time and Part-Time salary schedules, the College’s contribution to health care premiums and parking fees.

11. During negotiations, the Federation and the College discussed concepts for changes to Article 7 on Assessment, but were not able to reach agreement prior to the conclusion of negotiations. The Federation and the College agree to maintain the current language on Assessment and to continue their discussions in CAM with a goal of reaching a final conclusion by the end of the 2005-2006 academic year.
